Terms of Service

Please read these Terms of Service (“Terms”) carefully before using ModyPixl, operated by MVIRAI (“we”, “our”). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms — Age Requirements

By creating an account or using ModyPixl, you agree to these Terms and our Privacy Policy and Refund & Cancellation Policy. You must verify your email address before using AI generation features.

• You must be 18 or older. ModyPixl is an adult service. By creating an account, and again before every AI generation, you confirm that you are at least 18 years old (or the age of majority where you live, if higher). We do not ask for your date of birth or identity documents; your confirmation is the basis on which we provide the Services. Accounts we identify as belonging to a minor are closed and the data deleted.
• Photos and voices of children. Section 7 sets out the strict limits on content involving minors.

2. License to Use

ModyPixl grants you a personal, non-exclusive, non-transferable, limited licence to use the Services for your personal or business creative projects. This licence does not permit you to: resell access to ModyPixl, reverse engineer the app, automate generation through unofficial means, scrape templates, or use the Services to train any competing AI model.

3. Plans, Credits — How You Pay

ModyPixl offers subscription plans billed weekly, monthly or yearly and one-time credit top-ups. Current prices for all plans and top-ups are always shown on the pricing page at modypixl.com/pricing and on the checkout screen — those are the canonical sources of current pricing.

• Subscriptions. Each plan is valid for the billing period offered for that plan (weekly on Starter only; monthly on every plan; yearly on every plan except Director), includes an allotment of AI-generation credits, and unlocks plan-specific features — higher tiers unlock more. Weekly plans grant their credits each week; monthly and yearly plans grant their credits every month (a yearly plan is paid once and its credits are added month by month, not all at once). On Starter, Creator and Blogger, unused plan credits expire at the end of each credit period. On Influencer and Director, unused plan credits roll over for two months, up to one period's allowance; rolled-over credits end if the plan is cancelled. Subscriptions renew automatically until cancelled. When you cancel, future charges stop and your plan stays active until the end of the period you have paid for; plan features and any remaining plan credits end with that period.
• Subscriptions are a virtual product and are non-refundable once the billing period has started. Cancel at any time to stop the next charge; a started period is not refunded, in full or in part, except where the law requires it. Credits for a generation that fails or never reaches you are still returned to your balance automatically.
• Credit top-ups. Members on any paid plan can buy one-time credit top-ups at any time. Top-up credits are valid for your billing period — 30 days from purchase on weekly and monthly plans, 12 months on yearly plans — and are not removed if you later cancel.
• Taxes. Prices shown in Indian Rupees on the website are base prices; applicable GST (currently 18%) is added at checkout and the final amount is shown before you pay. A tax invoice is issued with every payment.
• Purchases inside the mobile apps (when released). The iOS and Android apps are not yet available. When they launch, plans and credit packs will also be sold inside them through the App Store and Google Play, at prices that may be higher than on the website because they include the store's commission and tax handling. Credits and plans will then work everywhere you sign in with the same account.
• How credits are used. Each AI generation consumes the credit cost shown at the point of generation, when the generation is requested. If a generation fails for a reason on our side, the consumed credits are automatically returned to your balance. No plan or credit balance is free, unlimited, or perpetual — anything to the contrary is not a term of this agreement.
• Welcome credits. New accounts receive a one-time promotional grant of welcome credits on signup (currently 50). Welcome credits are a free promotional benefit, hold no cash value, are non-refundable and non-transferable, and the amount may be changed or withdrawn for future signups at any time.
• Accounts. Creating an account is free of charge. Accounts may be shown advertising: advertising appears on free accounts and lower-priced plans, and our top two plans are ad-free. See our Privacy Policy for advertising disclosures.
• Feature availability by plan. Features may vary by plan and may change over time. The current feature matrix for each plan lives on the pricing page at modypixl.com/pricing.
• Invite rewards. You can share the invite link in your account. When someone creates a new account through your link and makes their first purchase, you receive the bonus credits shown in your account, up to the monthly limit shown there. Nothing is earned for sign-ups alone. A reward is reversed if that purchase is refunded or charged back. Inviting yourself, creating accounts to collect rewards, or spamming links is not allowed and forfeits rewards. Bonus credits are valid for 12 months and have no cash value. We may change or end the programme at any time; rewards already earned are kept.

4. AI Content — Disclosure, Ownership, and Identification

ModyPixl uses generative AI to produce images, videos, audio, and other media (“AI Output”). You acknowledge that:

• AI Output is generated by machine-learning models.It may include inaccuracies, unrealistic details, or unexpected artefacts. Treat it as a creative draft, not a factual record.
• All AI Output carries embedded, machine-readable AI-provenance metadata. Images include provenance text chunks (e.g. PNG metadata), and video/audio files carry equivalent container metadata, including the IPTC digital source type trainedAlgorithmicMedia. This labelling supports the EU AI Act Article 50 transparency requirement, India's IT Rules 2021 (synthetically generated information labelling), and similar regulations elsewhere. You must not remove, strip, or tamper with this metadata when sharing or republishing AI Output — doing so violates these Terms and may violate disclosure laws in your jurisdiction.
• You own the AI Output you generate with your account, subject to your compliance with these Terms and the licence in Section 5. We do not claim ownership of your creations. Because AI Output is machine-generated, any resemblance to real persons, places, or existing works is coincidental, and we make no warranty that AI Output is free of third-party rights — clearing such rights before commercial use is your responsibility.
• Personal use on the free plan; commercial use on paid plans. AI Output generated while your account is on the free plan is licensed to you for personal, non-commercial use only. AI Output generated while you hold an active paid plan may be used for any lawful purpose, including commercial use, and that right survives the end of your plan for Output generated during it. This is a licence term — we do not inspect or tag your Output to enforce it. Generated music and audio are the one exception: they are licensed only for use inside theModyPixl output they were generated for, on every plan — see Section 6A.
• You are responsible for what you upload and what you do with the result. You must hold the rights to every image, video, audio clip, and likeness you upload, and you must use the AI Output lawfully in every jurisdiction where you publish it. Impersonating a real person — their face, voice, or identity — without their consent is prohibited (see Section 7). AI Output is a creative work: it is not evidence, journalism, or medical, legal, or financial advice, and must not be presented as a genuine recording of something that did not happen.
• Disclose AI Output as AI-generated. Because it is synthetic media, tell your audience it was made with AI wherever a reasonable viewer might otherwise take it as real — and you must do so where the law or the publishing platform requires it (see Section 9).

5. Your Licence to Us When You Use AI Features

When you use AI features, you grant ModyPixl a limited, non-exclusive, royalty-free licence to process your inputs (images, prompts, audio reference) solely to deliver the requested output. Inputs are sent to our servers, processed on infrastructure we operate (this covers AI templates and the online photo, video, audio and document tools alike), and not retained beyond the duration of the request (see our Privacy Policy). Face and voice uploads for AI templates are deleted once your generation finishes and are never kept.

This licence is strictly limited to producing the output you asked for. Specifically:

• We do not use your inputs, prompts, or outputs to train, fine-tune, or evaluate any AI model.
• We do not sell, rent, licence, or publish your content, and we do not share it with anyone beyond the infrastructure processors required to run the service (listed in Privacy Policy).
• We do not use your content for advertising, profiling, or in ModyPixl marketing without your separate, explicit permission.

6. Visible Watermark

Designs exported from the editor carry a small visible ModyPixlmark on the free plan and are limited in size; paid plans export larger and without the mark, as described on the pricing page. The free in-browser utilities (resize, compress, convert and similar) run entirely on your device and add no mark. Every AI-generated video carries a visible ModyPixl “AI generated” label onevery plan, and AI-generated images carry it on the free plan; where present, it identifies the content as AI-made and must not be removed, cropped out or obscured. The embedded AI-provenance metadata described in Section 4 is always included, on every plan, and must not be removed.

6A. Generated Music and Audio

Some templates and add-ons produce music, songs, background beds, voice-overs and other audio (“Generated Audio”). Generated Audio is treated differently from the rest of your AI Output:

• Licensed for use inside your ModyPixl output only. You may publish, share and (on paid plans) commercially use the video, image or presentation that ModyPixl generated the audio for, with that audio in it. That is the whole licence.
• No standalone distribution. You must not extract, separate, re-record or distribute Generated Audio on its own, in whole or in part, in any format.
• No music distributors or streaming services. You must not upload Generated Audio, or any work whose substance is Generated Audio, to music distributors, streaming or download platforms such as Spotify, Apple Music, YouTube Music, JioSaavn, Amazon Music, SoundCloud, Bandcamp or similar services, nor to distributors that feed them.
• No resale, no sync licensing. You must not sell, license, sub-license, rent or otherwise make Generated Audio available to others as audio, including as a stock track, sample, ringtone, beat or sound library.
• No authorship or rights-management claims. You must not register Generated Audio with a collecting society, publisher or rights database, register it as a sound recording or composition, or assert it through YouTube Content ID, Meta Rights Manager or any similar system. Where such a system flags Generated Audio, you must not contest the claim on the basis of ownership.
• All rights reserved. All right, title and interest in Generated Audio, including any copyright in the composition and the sound recording to the extent it subsists, is owned and reserved by MVIRAI (ModyPixl). Nothing in these Terms transfers it to you.
• Applies on every plan. This Section applies to the free plan and to every paid plan, including plans that otherwise grant commercial use of AI Output. The commercial-use grant in Section 4 does not extend to Generated Audio beyond the use described in the first bullet.

Audio you upload yourself (your own voice sample, your own song) stays yours; this Section covers only audio that ModyPixl generates.

7. Consent — Faces, Voices, Children

You are solely responsible for ensuring you have all necessary rights and consents before uploading any photo or voice recording to ModyPixl. You agree that you will NOT upload:

• Faces or voices of people who have not given you clear permission to use them in AI-generated content. This includes friends, family, colleagues, or anyone else.
• Faces, voices, or names of public figures, celebrities, politicians, or any identifiable real person you do not personally know and have explicit consent from.
• Images of children for transformations into adult-context output.
• Images of deceased persons without rights/consent from the appropriate next-of-kin or rights holder.

Templates that take face or voice input show a consent acknowledgement before upload. Ticking that box is your declaration under these Terms that you have the necessary consent. False declarations are grounds for account termination and may expose you to civil or criminal liability under applicable law. If you believe your face or voice has been used on ModyPixl without your consent, email us at contact@modypixl.com and we will investigate and act promptly.

Sharing results that show other people

Consent to create is not consent to publish. Results from romantic, intimate, or personal templates (for example kiss, hug, and couple videos) are private media of the people shown in them. You may share such a result publicly — on YouTube, Instagram, WhatsApp status, or any other platform or social medium — only if every person depicted has agreed to that specific public sharing. Our recommendation is to keep intimate results private: send them directly to the people involved rather than posting them to a public feed. Publishing intimate AI-generated media of a real person without their agreement may be a criminal offence in many jurisdictions and is a violation of these Terms that can lead to account termination.

8. Acceptable Use — Hard Lines

ModyPixl is for improving creativity, not nudity. You must NOT use ModyPixl to create, distribute, or attempt to create:

• Nudity, pornography, or sexually explicit content of any kind — whether uploaded as an input or requested as an output. This is a hard product line, not a settings toggle.
• Child Sexual Abuse Material (CSAM) of any kind. Any attempt is reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement, account is terminated permanently, and identifying information is preserved for the report.
• Non-consensual intimate imagery of any real person (deepfake nudity, sexualisation of someone's face, etc.). Any attempt is reported and account terminated permanently.
• Deepfakes of public figures, politicians, or celebrities intended to deceive — whether visual (fake events, fake endorsements) or audio (a cloned or synthesised voice made to say things the real person never said). Cloning or imitating any real person's voice without their consent is prohibited. Election-period deepfakes are specifically forbidden.
• Content depicting graphic violence, gore, incitement to violence, terrorism, weapons of mass destruction, or instructions for manufacturing weapons.
• Hate speech, harassment, doxxing, or content that demeans individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected class.
• Content that infringes copyright, trademark, or other intellectual-property rights of others (including likenesses of characters protected by law).
• Content used for fraud, scams, impersonation, phishing, or misleading commercial claims.
• Content that violates the law of your jurisdiction or any jurisdiction in which the content is published.

We enforce these limits with multi-layer content moderation: prompt-level safety filters (multi-language), automatic screening of every uploaded image and video before generation begins, and human review of flagged accounts. Requests that fail screening are blocked before generation begins, and the credits for the blocked generation are refunded to your wallet. We may immediately and without notice block any prompt, reject any generation, or suspend or terminate any account that violates this Section — repeat violations lead to account termination, and CSAM or non-consensual intimate imagery attempts are reported to the authorities where legally required.

8A. Reporting Content, Takedowns and Intellectual Property

If you believe content generated or displayed through ModyPixluses your likeness, voice or copyrighted work without permission, or otherwise breaks Section 8, report it at modypixl.com/report or by email to contact@modypixl.com with a link or job reference, a description of the problem and your contact details. We acknowledge reports within 2 business days, remove or disable content that violates these Terms, and may suspend the account responsible. Where a report concerns copyright we follow a notice-and-takedown process and the account holder may submit a counter-notice. Knowingly false reports may lead to the reporter's own account being closed.

9. Output Disclosure When You Publish

When you publish AI Output to a platform that requires AI-content disclosure (e.g., YouTube's “altered or synthetic content” flag, the EU AI Act labelling rule, election rules in various jurisdictions), you are responsible for marking the content as AI-generated and for complying with the disclosure laws of your jurisdiction. The machine-readable provenance metadata we embed helps downstream platforms and detectors verify AI origin, but you must still set the platform-level disclosure flags yourself, and you must not strip the embedded metadata when sharing.

10. Results Are Held Briefly — Download Promptly

ModyPixl is not a cloud drive. When a generation completes, the result waits for you in My Generations for a short download window — a matter of hours, with the remaining time shown on the result itself — and is then permanently purged from our servers. We keep no archive and cannot restore an expired result.

• It is your responsibility to download your result while the window is open. Save it to your own device or storage.
• A successful generation you did not download is not refundable. If we delivered a working result and the window expired before you saved it, the credits for that generation stay consumed and re-generating costs credits again.
• A generation that never reached you is refunded automatically. If a generation fails, or completes but is never delivered to you, the credits are returned to your balance without you having to ask — see Refund & Cancellation Policy §4.

11. Service Availability, Quality Classes, and Reliability

We aim to keep the Services available and generation running smoothly. However, individual generations can fail for transient technical reasons. If a generation fails for a reason on our side, the credits consumed for it are automatically returned to your balance. See Refund & Cancellation Policy §4 for details.

Video generation is offered in quality classes described as SD video generation and HD video generation. Output resolution, duration, and processing parameters may be adjusted over time to maintain service quality and availability.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT GENERATED OUTPUT WILL MATCH ANY SPECIFIC EXPECTATION; AI MODELS ARE INHERENTLY VARIABLE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODYPIXL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES, INCLUDING ANY USE OR MISUSE OF AI OUTPUT BY YOU OR THIRD PARTIES.

14. Indemnity

You agree to indemnify and hold ModyPixl harmless from any claim, demand, or liability (including legal fees) arising from (a) your violation of these Terms, (b) your violation of any third party's rights, including consent, privacy, copyright, or publicity rights, or (c) any AI Output you create and publish using the Services.

15. Termination

We may suspend or terminate your account for violation of these Terms, with or without notice. We will permanently terminate accounts that attempt to create CSAM or non-consensual intimate imagery and report such attempts to the appropriate authorities. You may delete your account at any time from Settings → Account. Termination does not entitle you to a refund of unused credits (see Refund Policy).

Appeals. If your account has been suspended, blocked, or rate-limited and you believe that was a mistake, you can appeal by emailing contact@modypixl.com from the address on the account. Tell us what you were trying to do and we will review it, normally within 2 business days, and reinstate the account if the block was in error. Appeals are available for every enforcement action except permanent terminations for CSAM or non-consensual intimate imagery, which are final and reported to the authorities.

16. Governing Law

These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms shall be resolved through binding arbitration seated in Bangalore, India, except where prohibited by law or where mandatory consumer-protection provisions of your local jurisdiction (EU/UK/India consumer law) apply.

17. Changes to Terms

We may update these Terms. We will notify you of material changes at least 14 days in advance via email or in-app notification. Continued use after changes constitutes acceptance. Material changes that adversely affect existing wallets will not apply retroactively to credits already purchased.
