Terms of Service

Please read these Terms of Service (“Terms”) carefully before using ModyPixl (“we”, “our”). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using ModyPixl, you confirm that you are at least 13 years of age and agree to these Terms and our Privacy Policy and Refund & Cancellation Policy. If you are under 18, a parent or guardian must agree on your behalf. You must verify your email address before using AI generation features.
2. License to Use
ModyPixl grants you a personal, non-exclusive, non-transferable, limited licence to use the Services for your personal or business creative projects. This licence does not permit you to: resell access to ModyPixl, reverse engineer the app, automate generation through unofficial means, scrape templates, or use the Services to train any competing AI model.
3. Credit Model — How You Pay
ModyPixl runs on a credit-based, pay-as-you-go model. You buy credit top-up packs (1 credit = US $0.01) and each AI generation deducts the credit cost shown on its template card. There are no monthly or annual subscriptions. Credits do not expire.

4. AI Content — Disclosure, Ownership, and Identification
ModyPixl uses generative AI to produce images, videos, audio, and other media (“AI Output”). You acknowledge that:
- AI Output is generated by machine-learning models.It may include inaccuracies, unrealistic details, or unexpected artefacts. Treat it as a creative draft, not a factual record.
- All AI Output carries embedded, machine-readable AI-provenance metadata. Images include provenance text chunks (e.g. PNG metadata), and video/audio files carry equivalent container metadata, including the IPTC digital source type trainedAlgorithmicMedia. This labelling supports the EU AI Act Article 50 transparency requirement, India's IT Rules 2021 (synthetically generated information labelling), and similar regulations elsewhere. You must not remove, strip, or tamper with this metadata when sharing or republishing AI Output — doing so violates these Terms and may violate disclosure laws in your jurisdiction.
- You own the AI Output you generate with your account, subject to your compliance with these Terms and the licence in Section 5. We do not claim ownership of your creations. Because AI Output is machine-generated, any resemblance to real persons, places, or existing works is coincidental, and we make no warranty that AI Output is free of third-party rights — clearing such rights before commercial use is your responsibility.
5. Your Licence to Us When You Use AI Features
When you use AI features, you grant ModyPixl a limited, non-exclusive, royalty-free licence to process your inputs (images, prompts, audio reference) solely to deliver the requested output. Inputs are sent to our backend, processed on our self-hosted GPU infrastructure, and not retained beyond the duration of the request (see Privacy Policy §3).
We do not use your inputs or outputs to train any AI model.
6. Visible Watermark
By default, AI Output may include a small visible ModyPixl watermark. You can remove the visible watermark on individual generations by paying the additional credit charge shown at the point of generation. The embedded AI-provenance metadata described in Section 4 is always included, regardless of payment, and must not be removed.
7. Consent — Faces, Voices, Children
You are solely responsible for ensuring you have all necessary rights and consents before uploading any photo or voice recording to ModyPixl. You agree that you will NOT upload:
- Faces or voices of people who have not given you clear permission to use them in AI-generated content. This includes friends, family, colleagues, or anyone else.
- Faces, voices, or names of public figures, celebrities, politicians, or any identifiable real person you do not personally know and have explicit consent from.
- Images of children for transformations into adult-context output.
- Images of deceased persons without rights/consent from the appropriate next-of-kin or rights holder.
Templates that take face or voice input show a consent acknowledgement before upload. Ticking that box is your declaration under these Terms that you have the necessary consent. False declarations are grounds for account termination and may expose you to civil or criminal liability under applicable law. If you believe your face or voice has been used on ModyPixl without your consent, email us at contact@mvirai.com and we will investigate and act promptly.
8. Acceptable Use — Hard Lines
ModyPixl is for improving creativity, not nudity. You must NOT use ModyPixl to create, distribute, or attempt to create:
- Nudity, pornography, or sexually explicit content of any kind — whether uploaded as an input or requested as an output. This is a hard product line, not a settings toggle.
- Child Sexual Abuse Material (CSAM) of any kind. Any attempt is reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement, account is terminated permanently, and identifying information is preserved for the report.
- Non-consensual intimate imagery of any real person (deepfake nudity, sexualisation of someone's face, etc.). Any attempt is reported and account terminated permanently.
- Deepfakes of public figures, politicians, or celebrities intended to deceive (fake statements, fake events, fake endorsements). Election-period deepfakes are specifically forbidden.
- Content depicting graphic violence, gore, incitement to violence, terrorism, weapons of mass destruction, or instructions for manufacturing weapons.
- Hate speech, harassment, doxxing, or content that demeans individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected class.
- Content that infringes copyright, trademark, or other intellectual-property rights of others (including likenesses of characters protected by law).
- Content used for fraud, scams, impersonation, phishing, or misleading commercial claims.
- Content that violates the law of your jurisdiction or any jurisdiction in which the content is published.
We enforce these limits with a multi-layer content-moderation pipeline: prompt-level safety filters (multi-language), automatic screening of every uploaded image and video before generation begins, and human review of flagged accounts. Requests that fail screening are blocked before any model runs, and the credits for the blocked generation are refunded to your wallet. We may immediately and without notice block any prompt, reject any generation, or suspend or terminate any account that violates this Section — repeat violations lead to account termination, and CSAM or non-consensual intimate imagery attempts are reported to the authorities where legally required.
9. Output Disclosure When You Publish
When you publish AI Output to a platform that requires AI-content disclosure (e.g., YouTube's “altered or synthetic content” flag, the EU AI Act labelling rule, election rules in various jurisdictions), you are responsible for marking the content as AI-generated and for complying with the disclosure laws of your jurisdiction. The machine-readable provenance metadata we embed helps downstream platforms and detectors verify AI origin, but you must still set the platform-level disclosure flags yourself, and you must not strip the embedded metadata when sharing.
10. Service Availability and Reliability
We aim to keep the Services available and the AI workers running. However, individual generations can fail for transient reasons (model timeout, GPU allocation failure, network issues). For failures on our side, we auto-retry until success and do not charge you for the failed attempts. See Refund & Cancellation Policy §4 for details.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT GENERATED OUTPUT WILL MATCH ANY SPECIFIC EXPECTATION; AI MODELS ARE INHERENTLY VARIABLE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODYPIXL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES, INCLUDING ANY USE OR MISUSE OF AI OUTPUT BY YOU OR THIRD PARTIES.
13. Indemnity
You agree to indemnify and hold ModyPixl harmless from any claim, demand, or liability (including legal fees) arising from (a) your violation of these Terms, (b) your violation of any third party's rights, including consent, privacy, copyright, or publicity rights, or (c) any AI Output you create and publish using the Services.
14. Termination
We may suspend or terminate your account for violation of these Terms, with or without notice. We will permanently terminate accounts that attempt to create CSAM or non-consensual intimate imagery and report such attempts to the appropriate authorities. You may delete your account at any time from Settings → Account. Termination does not entitle you to a refund of unused credits (see Refund Policy).
15. Governing Law
These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms shall be resolved through binding arbitration seated in Bangalore, India, except where prohibited by law or where mandatory consumer-protection provisions of your local jurisdiction (EU/UK/India consumer law) apply.
16. Changes to Terms
We may update these Terms. We will notify you of material changes at least 14 days in advance via email or in-app notification. Continued use after changes constitutes acceptance. Material changes that adversely affect existing wallets will not apply retroactively to credits already purchased.
